1. Pomoc publiczna nie może zostać udzielona przedsiębiorcy znajdującemu się w trudnej sytuacji w rozumieniu art. 2 pkt 18 rozporządzenia nr 651/2014. 2. Pomoc publiczna nie może zostać udzielona:
1) na realizację inwestycji technologicznej oraz na realizację inwestycji ekologicznej w sytuacjach określonych w art. 1 ust. 2, ust. 3 lit. a–d, ust. 5 oraz art. 13 rozporządzenia nr 651/2014;
2) na finansowanie ryzyka oraz dla przedsiębiorców rozpoczynających działalność w przypadkach, o których mowa w art. 1 ust. 2 lit. c oraz d, ust. 3 lit. b–d oraz ust. 5 rozporządzenia nr 651/2014, z zastrzeżeniem że pomoc na finan- sowanie ryzyka może zostać udzielona przedsiębiorcy na umiędzynarodowienie jego działalności i ekspansję zagra- niczną pod warunkiem, że taki rozwój jest uzasadniony i zgodny z biznesplanem dla inwestycji w tego przedsiębiorcę. 3. Pomoc finansowa nie może zostać udzielona na działalność gospodarczą:
1) w zakresie produkcji lub wprowadzania do obrotu napojów alkoholowych;
2) w zakresie produkcji lub wprowadzania do obrotu treści pornograficznych;
3) w zakresie obrotu materiałami wybuchowymi, bronią i amunicją;
4) w zakresie gier losowych, zakładów wzajemnych, gier na automatach i gier na automatach o niskich wygranych;
5) w zakresie produkcji lub wprowadzania do obrotu środków odurzających, substancji psychotropowych lub prekurso- rów oraz nowych substancji psychoaktywnych;
6) w przypadkach określonych w art. 7 ust. 1 rozporządzenia Parlamentu Europejskiego i Rady (UE) 2021/1058 w sprawie Europejskiego Funduszu Rozwoju Regionalnego i Funduszu Spójności (Dz. Urz. UE L 231 z 30.06.2021, str. 60, z późn. zm.5)). 4. Jeżeli przedsiębiorca ubiegający się o pomoc finansową prowadzi działalność gospodarczą w sektorach, o których mowa w art. 1 ust. 2 lit. c i ust. 3 rozporządzenia nr 651/2014 oraz art. 1 ust. 1 rozporządzenia nr 1407/2013, w związku z którą nie może zostać udzielona taka pomoc, oraz inną działalność gospodarczą, pomoc finansowa może zostać mu udzielona pod warunkiem, że przedsiębiorca ten zobowiąże się do wyodrębnienia ewidencji w ramach prowadzonych ksiąg rachunkowych w ramach działalności gospodarczej z obu sektorów, w tym do przypisywania przychodów i kosztów na podstawie konsekwentnie stosowanych i mających uzasadnienie metod. 5. Pomoc finansowa nie może zostać udzielona ani wypłacona przedsiębiorcy, na którym ciąży obowiązek zwrotu pomocy publicznej wynikający z decyzji Komisji Europejskiej uznającej pomoc przyznaną przez to samo państwo człon- kowskie za niezgodną z prawem oraz z rynkiem wewnętrznym.
